PRIVACY POLICY

Procolony Pte. Ltd. (“Procolony”) has created this Privacy Policy in order to demonstrate our firm commitment to privacy. The following discloses the information gathering and dissemination practices for the Procolony website, in compliance with the requirements of the Personal Data Protection Act 2012 (“PDPA”).

By using the Procolony website and accepting the User Agreement, you also agree to this Privacy Policy. If you do not agree to this Privacy Policy, you must not use the Procolony website. The terms "We," "Us," "Our," or "Procolony" includes Procolony and our affiliates.

1. What information do we collect?

“Personal Data” means any data about an individual who can be identified:

  1. from that data; or
  2. from that data and other information to which Procolony has or is likely to have access to, including data in Procolony’s records as may be updated from time to time.

Types of Personal Data that may be collected by Procolony include but are not limited to:

  1. Name and contact information, such as e-mail address, phone number, mobile telephone number, fax number, physical address, and (depending on the service used) sometimes financial information, such as bank account numbers;
  2. transactional information based on your activities on the websites (such as bidding, buying, selling, item and content you generate or that relates to your account), billing and other information you provide to purchase an item;
  3. personal information you provide to us through correspondence, chats, dispute resolution, or shared by you from other social applications, services or websites;
  4. additional personal information we ask you to submit to authenticate yourself (for example, we may ask you to send us an ID to answer additional questions online to help verify your identity); and
  5. information from your interaction with our websites, services, content and advertising, including, but not limited to, device ID, device type, location, geo-location information, computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information.

In addition, Procolony also collects the following types of information:

  1. Aggregate Information: Procolony collects non-identifying, general, generic and aggregate information to better design our website and services.
  2. Non-Personal Information: Procolony may collect non-personal information as you use Procolony’s website. When you use the website, Procolony, third-party service providers (e.g. Google Analytics), and partners may receive and record non-personal information from cookies, server logs, and similar technology from your browser or mobile device, including your IP address.
  3. We may combine some Non-Personal Information with the Personal Data we collect. Where we do so, we will treat the combined information as Personal Data if the resulting combination may be used to readily identify or locate you in the same manner as Personal Data alone.

Procolony collects your Personal Data, Aggregate Information and Non-Personal Information when you register on the Procolony website and when you visit the pages on Procolony’s website.  By accessing Procolony’s website, you have consented to the collection of the foregoing types of data and information by Procolony, for the purposes set out in this Privacy Policy.

You shall make reasonable efforts to ensure that all Personal Data provided to Procolony is complete, accurate, true and correct. Further, you shall give Procolony notice in writing as soon as reasonably practicable should your Personal Data be updated or changed after such disclosure.

2. How do we store your Personal Data?

We use third party vendors for web hosting, therefore your Personal Data may be transferred to and stored on servers in various locations both in and outside of Singapore. Procolony maintains control of your Personal Data. We protect your Personal Data using technical and administrative security measures to reduce the risks of loss, misuse, unauthorised access, disclosure and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centres, and information access authorisation controls.

3. How do we use your Personal Data?

When you use the Procolony website, we may request certain information. Procolony does not share any of your Personal Data or transactional information with any person or entity, other than as set out in this Privacy Policy. No other third party receives your Personal Data or other transactional data except for those with whom you have transactions and share that information. The information we collect is used to improve the content of our website, notify consumers about updates to our website and for communications, such as customer service.

Communications: We may send you a welcome e-mail to verify your account and other transactional e-mails for operational purposes, such as billing, account management, or system maintenance. You may only stop those e-mails by terminating your account. We may also send you promotions, product announcements, surveys, newsletters, developer updates, product evaluations, and event information or other marketing or commercial e-mails. You can opt out of receiving these e-mail communications from Procolony at any time by unsubscribing using the unsubscribe link within each e-mail, updating your e-mail preferences on your Procolony account or emailing us to have your contact information removed from our e-mailing list or registration database.

Marketing: You agree that we may use your Personal Data to tell you about our services and tools, deliver targeted marketing and promotional offers based on your communication preferences, and customise measure and improve our advertising. You can unsubscribe from e-mails at any time by clicking the unsubscribe link contained in the e-mail.

We do not rent, sell, or share your Personal Data with other people or non-affiliated companies for marketing purposes (including direct marketing purposes) without your permission. We may use and share Non-Personal Information.

4. Sharing your Information

When you set "Publish Profile" to "On" in your profile page, you give consent for your name to be listed in our directory of professionals with the following information that you provide in your profile, and agree that the following information be made visible to all registered users of Procolony: ​

  1. Profession;

  2. First Name and Last Name;

  3. Availability and Available Time;

  4. Expected Salary/Fees;

  5. Country;

  6. Industry Sector;

  7. Time Zone;

  8. Experience (excluding supporting documents - see Note 1**);

  9. Education/Qualifications (excluding supporting documents);

  10. Professional Certification/Licenses (excluding supporting documents);

  11. Skills; and

  12. Portfolio/resume/curriculum vitae.

** Note 1: Supporting documents will only be shared with potential employers who shortlist your profile after you have bid for their jobs.

When you bid for jobs in Procolony, and the employer who posted the job that you bid for shortlists your profile, all information in the following sections of your profile page (except Address), including all supporting documents attached, will be provided to that employer:

  1. General Profile, including your e-mail and attached portfolio/resume/curriculum vitae;
  2. Contact Details, including contact numbers, Skype ID, social media links, website and company name (if any); 
    -- Note: we do not disclose your address.
  3. Experience;
  4. Education/Qualifications;
  5. Professional Certification/Licenses; and
  6. Publications.

We may disclose your Personal Data to respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates the rights of others, or protect anyone's rights, property, or safety. Such information will be disclosed in accordance with applicable laws and regulations. As stated above, we do not disclose your Personal Data to third parties for their marketing purposes without your prior consent.

We may disclose your Personal Data to our related bodies corporate and third party suppliers and service providers located overseas for some of the purposes listed above. We take reasonable steps to ensure that the overseas recipients of your Personal Data do not breach the privacy obligations relating to your Personal Data.

We may disclose your Personal Data upon a business transition; At the sale or transfer of Procolony and/or all or part of its assets, your personal information may be among the items sold or transferred.

We may share aggregate data with advertisers and other third parties. Procolony uses industry-standard encryption technologies when transferring and receiving consumer and transaction data exchanged with our site.

5. Retention of Personal Data

Procolony shall retain your Personal Data as may be required for its legal or business purposes until such time that Procolony reasonably determines that such Personal Data is no longer necessary for its legal or business purposes.

6. Cookies

Cookies are pieces of data assigned by a web server that uniquely identify the browser on your computer or device. Procolony uses cookies called "persistent" cookies to enable the site to remember you on subsequent visits, speeding up or enhancing your experience of services or functions offered. Cookies also enable our systems to gather information about your navigational patterns through the site. You have the option to disable cookies at any time through your browsers. We may also store your website activity in cookies which may be used by third party vendors, including Google, to serve ads based on your behaviour on our website.

The third party vendors (e.g. Google Analytics) may receive and record non-personal information from cookies, server logs, and similar technology from your browser or mobile device, including your IP address. You may opt out of Google's use of cookies by visiting the Google advertising opt-out page if you access our services with your login credentials from a social networking site (e.g., Facebook or Twitter) or if you otherwise agree to associate your Procolony account with a social networking account, we may receive personal information about you from such social networking site, in accordance with the terms of use and privacy policy of the social networking site. For example, Facebook may share with us your friend list, birthday, information about the interests of you or your friends or other personal information, in order to help us establish your account, tailor services to you and find other current or potential site users that you know. We may add this information to the information we have already collected from you via other aspects of the website. You are also subject to the social networking site's terms of use and privacy policy. We use the OAuth (open authorisation) protocol to enable us to access this information without collecting your password when you agree allow another application to access your account information.

7. Withdrawal of Consent, Access and Correction of Personal Data

You may withdraw your consent for Procolony to use your Personal Data for the purposes stated in this Privacy Policy.  Upon receiving such notice from you, Procolony may require up to thirty (30) days to process the withdrawal of your consent and securely dispose of your Personal Data.  During this period, Procolony shall be entitled to continue using your Personal Data for the purposes stated in this Privacy Policy.  Notwithstanding any withdrawal of consent by you, Procolony may contact you for other purposes in relation to the existing services that you have requested from Procolony.

You can update your Personal Data through your account profile settings. If you believe that your Personal Data that we possess is incorrect, incomplete or inaccurate, then you may request us to amend it.

Additionally, you may request access to your Personal Data at any time by contacting us at support@procolony.com. Where we hold your Personal Data that you are entitled to access, we will try to provide you with suitable means of accessing it (for example, by mailing or e-mailing it to you). We may charge you a fee to cover our administrative and other reasonable costs in providing the information to you. We will not charge for simply making the request and will not charge for making any corrections to your Personal Data.

There may be instances where we cannot grant you access to Personal Data of third parties that we possess. For example, we may need to refuse access if granting access would interfere with the privacy of such third parties or if it would result in a breach of confidentiality. If that happens, we will give you written reasons for any refusal.

8. Indemnity

You shall indemnify Procolony and its officers, employees, representatives and agents against all actions, claims, demands, losses, damages, expenses and costs arising out of any of your acts, omission or negligence that cause or result in Procolony to be in breach of the PDPA or other applicable laws.

9. Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of Singapore.

10. Changes to our Privacy Policy

We may amend the terms of this Privacy Policy from time to time. Any updated versions of this Privacy Policy will be posted on our website. Please review it regularly.
